In this privacy policy, we will refer to hibu Inc. using the terms "hibu", "us", "we" and "our". If we use the term "hibu Group", this means us, our ultimate parent company and its subsidiaries. The term "our Services" refers to any websites, mobile applications and other products or services that we own or run from time to time, including any mobile sites that you might access from your mobile device. If you use any of our Services, we call you a "user" and this policy applies to you. If you buy any of our Services, we call you an "advertiser" and you should refer to our privacy policy for advertisers.

We are committed to protecting and respecting your privacy. This privacy policy describes how we collect, use, share and process or otherwise handle information about you, and applies to information we collect when you access or use our Services, or when you otherwise interact with us.

hibu complies with the US-EU Safe Harbor Privacy Framework, including the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access and enforcement (collectively, the "Privacy Principles"). hibu adheres to the Privacy Principles and is registered with the US Department of Commerce. This privacy policy complies with the Privacy Principles and applies to all personal information we receive from the European countries that participate in the Safe Harbor program, as amended from time to time.   1. 1 – The information we collect and how we collect it

    To provide you with our Services, we may need information about you.

    If you use our Services, you are in control of what information we collect about you, but if you choose not to share your information, you may not be able to access or use all or part of our Services.

    We collect information about you when you:

    • access or use our Services;
    • order directories or any of our other Services;
    • create, look at or change details of any account for our Services;
    • use the features or functionalities on our Services, such as where you can email information about a business or service that you locate on our Services to a friend;
    • request business details through our Services;
    • click on one of the ads that we put on other websites or services;
    • ask for information from us;
    • give us a testimonial or other feedback;
    • submit comments relating to blogs or articles featured on our Services;
    • submit a review for a business through our Services;
    • enter competitions or special promotions;
    • fill in surveys; or
    • speak to us on the telephone, including by using call recording.

    When you access or use our Services, the types of information that we may collect directly from you include your name or nickname, email address and any other information you choose to provide. In addition, we also may automatically collect information about you, including:

    • information about your use of our Services, including your Internet Protocol ("IP") address, browser type, access times, search criteria, pages viewed and the last page you viewed before navigating to our Services;
    • information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information; and
    • information about the location of your device when you access or use our Services through one of our mobile applications or otherwise consent to the collection of this information. Please note that, if you initially consent to our collection of location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. If you do so, our mobile applications or certain features thereof will no longer function. You may also stop our collection of location information by following the standard uninstall process to remove all of our mobile applications from your mobile device.

    We may also get information about you from third parties with whom we have a business relationship.

  2. 2 – How we use the information we collect about you

    Whenever you give us information about you, we will use it in accordance with this privacy policy.

    1. When you use our Services

      When you give us information while accessing or using our Services, we will use it for the purposes set out in this privacy policy, on the data entry forms, in any relevant terms or conditions and on pages or emails which link to the data entry forms.

    2. Cookies and other tracking technologies on our Services

      We use various technologies to collect information, and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Services and your experience thereon, better understand which areas and features of our Services are popular, and count visits. If you use our Services, your computer may store your last search using cookies. We also may collect information using web beacons (also known as "tracking pixels").       • target the ads or offers, such as banners, on our Services and on the websites and other services of other organizations; and
      • track the use of our internet banner ads and other links from our marketing partners' websites to our Services.

You cannot be personally identified from the information that we or the other organizations collect through these mechanisms.

    4. Third party websites and ad targeting

      We use third-party companies to serve ads and/or collect non-personally identifiable information when you visit our Services. These companies may use information (not including your name, address, email address or telephone number) about your visits to our Services and other websites in order to provide advertisements about goods and services that may be of interest to you (also known as “behavioral advertising”) on our Services, other websites and other forms of media. These companies often use a cookie, third-party web beacon or other tracking technology to collect this information.

      Additionally, if you visit our websites or interact with promotional email messages we send you, hibu may use this information to serve you ads in the form of marketing campaigns. These campaigns will highlight those of our Services that may be of interest to you. In order to make these marketing campaigns relevant to you, hibu uses information collected through the use of a cookie.

    5. Testimonials

      If you give us feedback, we may use it to improve our Services and we may publish it online or offline to promote our business and our Services.

    6. Comments submitted to our online blogs and articles; ratings and reviews

      If you wish to submit a comment or feedback on a blog or article featured on our Services, we may (but are not obliged to) publish your comment online or offline to promote our business and our Services. We will collect your name or nickname, which will be displayed next to your comment, and email address, which will not be published, but which we may use to contact you in relation to your comment.

      In addition, we may share ratings and reviews that you submit or post on our Services with other businesses with which we partner. We may also use your email address to inquire as to whether you would like to submit a rating or review on our Services in connection with your use of our Services.

    7. Mobile

      When you access or use our mobile Services, for example, by using your mobile phone or tablet device, we, or other organizations with which we work, may collect your mobile phone number, the make and model of your mobile phone or tablet device, unique device identifiers and details of your network operator, and may link a unique identifier to your mobile phone number. We need this information in order to make our mobile Services work on your device and to administer our Services. We, or other organizations with which we work, may also use it for market research or for analytics purposes. When you use our mobile Services, details of your search terms, map locations requested, route start and end points, and the time and date of any calls you make to businesses that you’ve found using our Services may be collected and used to analyze how you and other people use our Services and to improve our Services. If you use any Services with our mobile location-based services, we also may collect your unique device identifiers or GPS measurements and use them to provide our Services, to deliver relevant content to you, for analytics purposes, and to provide other information we think may interest you. If you give us your name, we will keep it and use it to personalize our Services to you.

    8. Telephone, email or text/SMS directory inquiries

      If you request details from us regarding a business via telephone, email or text/SMS using your mobile phone, we will use your mobile phone number to send you the details of the business you’ve requested. We may also record the time, date and day of the week and length of your call or text and the classification, business name and location you requested. We use these to analyze how people use our Services and to improve our Services.

    9. Ad syndication

      We use the websites of other companies to host advertising for our advertising customers. If you click on one of these advertisements, you will go through to our advertiser’s website and we will collect your IP address and use it to analyze how well the advertising works.

    10. Direct marketing

      We offer you the chance to receive important news from hibu and information about our Services, such as changes to the way you can use our Services and new products or services and special offers you might be interested in. For information on how to change your marketing preferences, please read section 3(a) – Your choices for marketing and how to manage them.

    11. Surveys

      Every now and again, we may ask you for your opinion on our Services. When we do surveys, we may use cookies or other on-device storage and may combine the information collected by those cookies or other on-device storage with your answers. We will make sure that the survey results do not identify you, or anyone else who fills in our surveys.

    12. Aggregated or de-identified information

      We may share aggregated or de-identified information (which cannot reasonably be used to identify you) or give anonymous statistics about our users to other, reputable organizations, but the information we provide will not include details that would allow these organizations to identify you.

  3. 3 – Your choices and how to manage them

    1. Marketing

      You can change your marketing preferences at any time by viewing and updating your account profile on our Services. You may request not to receive (i.e., "opt-out" of receiving) promotional email messages from us, by unchecking the checkbox beside the "I wish to receive updates and information" line on the account registration page. If you receive a marketing email message from us, you may click on the “Unsubscribe” link contained in that email to opt out of receiving similar email messages in the future. You may also opt out of receiving marketing materials from us by contacting our Customer Service Department at 1.800.YB.YELLOW.

      If you tell us that you do not want to receive direct marketing materials, we reserve the right to contact you in order to provide you with our Services that you request and for administration purposes.

    2. Cookies

      If you do not want a website to create a cookie on your computer, most web browsers provide you with the option to disable them. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.     3. On-device storage for our mobile Services

      Certain features and functionalities of our mobile Services cannot operate without on-device storage. If you do not want your information to be stored in this way, please do not install or use our mobile Services.

    4. Links to third party sites

      Links to external websites owned and operated by third parties ("Third Party Sites") may be presented in a format that enables us to keep track of whether these links have been followed. This information is used in aggregated form to improve our Services for our users and advertisers.

      We do not exercise control over Third Party Sites to which you may link from our Services. These Third Party Sites may place their own cookies or other files on your computer, or collect information from you. If you decide to access any Third Party Sites, you do so at your own risk, and we recommend that you visit and review the privacy policies of such Third Party Sites for more information about their information practices.

  4. 4 – With whom we may share information about you

    We may need to share your information with other organizations to provide you with our Services or information you ask for. We may share your information as follows or as otherwise described in this privacy policy:

    • with other companies in the hibu Group;
    • with vendors, consultants and other service providers who need access to such information to carry out work on our behalf;
    • with data processing companies, mailing houses and other third party suppliers working on our behalf;
    • with our selected partners and other third parties for their direct marketing purposes;
    • with research students, universities and other research and development organizations;
    • in response to a request for information if we believe disclosure is in accordance with applicable law, regulation or legal process, or as otherwise required by any applicable law, rule or regulation;
    • in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company;
    • with your consent or at your direction, including if we notify you through our Services that the information you provide will be shared in a particular manner and you provide such information; and
    • with other third parties in limited circumstances such as complying with legal requirements, preventing fraud and protecting the rights, property and safety of hibu and our users.

    With respect to sharing information with third parties that are working on our behalf, we first either ascertain that the third party subscribes to the Privacy Principles or is subject to the European Directive on Data Protection or another adequacy finding or enter into a written agreement with the third party requiring that the third party provide at least the same level of privacy protection as is required by the relevant Privacy Principles. Every now and again, we receive requests for information from government agencies, the police and other enforcement agencies or other third parties through subpoena or other valid legal process. If this happens, and there is a proper legal basis for providing information about you, we will provide it to the party asking for it.

  5. 5 – How we keep your information secure

    We take the security of your personal information seriously. hibu takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction.

  6. 6 – Accessing and updating your information

    1. Request not to use information

      You can ask us not to use your information for marketing purposes. For more information, please read section 3(a) – Your choices for marketing and how to manage them.

    2. Access to information

      You can ask to see information we hold about you (with some exceptions). If you would like a copy of the information we have collected about you, you should contact our data privacy officer.

    3. Keeping information up to date

      We limit our collection of information about you to that which is relevant for the intended business and legal purposes for which it is to be used. We do not use information about you in a way that is incompatible with the purposes for which it was collected or subsequently authorized by you. To the extent necessary for those purposes, we take steps to ensure that information about you is reliable for its intended use, accurate, complete and current.

      You have the right to review and update your personal details. You can do this through the “myYellowbook” or “My Account” section of our Services. We will delete your information at your request if it is not otherwise required to be retained by law or for legitimate business purposes. Because of the way we maintain certain Services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

      We will ask you to identify yourself and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required.

  7. 7 – What to do if you have a complaint or concern

    We (a) provide procedures for verifying that our commitments to adhere to this privacy policy have been implemented; (b) undertake obligations to remedy problems arising out of a failure to comply with this privacy policy; and (c) provide independent recourse mechanisms so that each individual's complaints and concerns regarding our handling of information about you under the Safe Harbor Program can be investigated and resolved and damages awarded where the applicable law or private sector initiatives so provide.

Should you have a complaint against hibu, we’ll try to resolve the complaint directly with you; however, if we are unable to resolve your dispute and you reside in the US, hibu has selected JAMS International as the independent recourse mechanism to resolve the dispute via arbitration. Additionally, hibu is also subject to the jurisdiction of the U.S. Federal Trade Commission.
